Fashiontree – Online Store Regulations

This document concerns the rules for concluding sales contracts via the store and contains the most important information about the Seller, the Store, and Consumer rights. The provisions concerning the Privileged Entrepreneur apply to contracts concluded from January 1, 2021.

1 DEFINITIONS

  • Business Days – days from Monday to Friday, excluding public holidays.
  • Consumer – a consumer as defined by the Civil Code.
  • Account – a free function of the Store (a service provided electronically), regulated by a separate set of terms, which allows the Buyer to create an individual account in the Store.
  • Buyer – any entity making purchases in the Store.
  • Privileged Buyer – a Consumer or a Privileged Entrepreneur.
  • Privileged Entrepreneur – a natural person entering into an agreement with the Seller directly related to their business activity, but not of a professional nature for them (definition applicable to contracts concluded from January 1, 2021).
  • Regulations – the regulations of the Fashiontree online store.
  • Store – The Fashiontree online store (fashiontree.pl) operated by the Seller at www.fashiontree.pl
  • Seller – COSMO INTERNATIONAL SP. Z.O.O, based in Pabianicka 76A (95-030), Rzgów, NIP: 6490006294, and REGON: 630536514.

3 TECHNICAL REQUIREMENTS

To properly use the Store, the following are required:

  • Internet access (via a computer, phone, or other devices) and a web browser with JavaScript enabled and cookies supported.

To place an order, in addition to the requirements mentioned above, an active email account is required.

4 SHOPPING IN THE STORE

  • The prices of products in the Store are gross prices (final prices including VAT).
  • The total order price consists of the product price (including VAT) and the delivery costs, as indicated in the Store.
  • The Buyer selects a product, adds it to the cart, chooses the delivery and payment methods, and provides the necessary information for order processing.
  • The order is placed when the Buyer confirms its content and accepts the Regulations.
  • Placing an order is equivalent to concluding a sales contract between the Buyer and the Seller.
  • The Seller will provide the Privileged Buyer with a confirmation of the sales contract on a durable medium at the latest when the goods are delivered.

The Buyer can make purchases with or without registering an account.

5 PAYMENTS

Orders can be paid for via:

  1. Bank transfer to the Seller’s account.
  2. Payment cards:
    • Visa
    • Visa Electron
    • MasterCard
    • MasterCard Electronic
    • Maestro
  3. Online payment platforms:
    • PayU
    • Woopayments

The Buyer agrees to receive electronic invoices from the Seller but may withdraw this consent.

6 ORDER PROCESSING

  • The Seller ensures the delivery of goods free from defects.
  • Order processing takes 1-2 business days.
  • If the Buyer selects an advance payment, order processing begins upon receipt of payment.
  • Deliveries are available in Poland and other EU countries.
  • Available delivery methods:
    • Courier service
    • InPost parcel lockers

7 RIGHT OF WITHDRAWAL

  • The Privileged Buyer has the right to withdraw from the contract within 14 days without providing any reason, except for the exceptions listed in §8.
  • The withdrawal period starts from the day the Buyer or an authorized third party receives the goods.
  • To exercise the right of withdrawal, the Buyer must notify the Seller using the contact details in §2. This can be done via mail or email. The provided sample withdrawal form is optional.

Returns:

  1. Damaged, cut, used, or visibly worn materials will not be accepted.
  2. If the return is due to Textil World’s fault, return shipping costs will be covered by the Seller. Otherwise, the Buyer bears the return shipping costs.
  3. Custom-printed fabric orders (with approved samples and contracts) can only be returned in case of printing errors.

Effects of Withdrawal:

  • The Seller refunds all payments, including standard delivery costs, within 14 days from the withdrawal notice.
  • Refunds are issued via the same payment method unless otherwise agreed.
  • The Seller may withhold the refund until receiving the returned goods.
  • The Buyer must return the goods within 14 days of notifying the withdrawal.

8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to contracts concerning:

  • Custom-made or personalized goods.
  • Perishable or short-shelf-life goods.
  • Sealed goods that cannot be returned once opened due to health/hygiene reasons.
  • Items that are irreversibly mixed with other goods.
  • Sealed audio/video recordings or software if unsealed.
  • Newspapers, periodicals, or magazines (except subscriptions).
  • Financial market-dependent prices beyond the Seller’s control.
  • Digital content delivered without a physical medium if the Buyer consented before the withdrawal period expired.

9 COMPLAINTS

  • The Buyer may file a complaint under statutory warranty or product guarantee (if applicable).
  • Complaints should be submitted using the contact details in §2.
  • If necessary, the Buyer must return the defective product, and if the Buyer is Privileged, the Seller covers return costs.
  • Complaints are processed within 14 days.

Alternative Dispute Resolution: If a complaint is unresolved, Consumers may seek alternative dispute resolution via:

10 PERSONAL DATA

  • The Seller is the data controller for personal data provided by the Buyer.
  • Detailed data processing policies are outlined in the Store’s Privacy Policy.

The purpose of data processing is to fulfill orders.
